1. Agreement to Terms

Welcome to Arka Studios. These Terms of Service (“Terms”) govern your use of our website and services. By accessing our website or engaging our photography and videography services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Arka Studios reserves the right to modify these Terms at any time. We will notify you of any changes by updating the “Last updated” date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

2. Services

Arka Studios provides professional photography and videography services including, but not limited to:

• Photography (portrait, product, food, sports, lifestyle)
• Videography (promotional videos, event coverage, documentaries)
• Event coverage (weddings, corporate events, celebrations)
• Commercial content creation (advertising, marketing campaigns)
• Post-production services (editing, color grading, retouching)

The specific scope of services will be detailed in individual project agreements or quotes provided to clients.

3. Booking and Payment

3.1 Booking Process

To book our services, clients must provide complete and accurate information about their project requirements. A booking is considered confirmed only after:

• Receipt of a signed service agreement or written confirmation
• Payment of the required deposit (typically 50% of the total fee)
• Written confirmation from Arka Studios

3.2 Payment Terms

Payment terms are as follows unless otherwise specified in writing:

• 50% deposit required at the time of booking
• Remaining 50% due before delivery of final files
• Payment can be made via bank transfer, UPI, or other agreed methods
• All prices are quoted in Indian Rupees (INR) unless stated otherwise

3.3 Additional Costs

Travel expenses, accommodation, special equipment rentals, and other additional costs will be communicated and agreed upon in advance. These costs are separate from the service fee.

4. Cancellation and Rescheduling

4.1 Client Cancellation

Cancellation policies are as follows:

• More than 7 days before the shoot: Full deposit refund minus a 10% administrative fee
• 3-7 days before the shoot: 50% of deposit refunded
• Less than 3 days before the shoot: No refund of deposit
• No-show: Full payment is due

4.2 Rescheduling

Rescheduling is subject to availability:

• More than 7 days notice: Free rescheduling (one time)
• 3-7 days notice: 25% rescheduling fee
• Less than 3 days notice: 50% rescheduling fee

4.3 Arka Studios Cancellation

In the unlikely event that Arka Studios must cancel a booking due to unforeseen circumstances (illness, emergency, or force majeure), we will:

• Provide as much notice as possible
• Offer a full refund of all payments made
• Attempt to reschedule at a mutually convenient time
• If available, arrange an alternative qualified photographer/videographer

5. Intellectual Property and Copyright

5.1 Ownership

All photographs and videos created by Arka Studios are protected by copyright law. Unless otherwise agreed in writing:

• Arka Studios retains copyright ownership of all images and videos
• Clients receive a license to use the delivered content for personal or agreed commercial purposes
• RAW files remain the property of Arka Studios unless explicitly included in the package

5.2 Usage Rights

Standard packages include a personal use license. Commercial usage rights must be negotiated separately and may incur additional fees. Clients may not:

• Sell or license the images to third parties
• Submit images to stock photography websites
• Use images for purposes not agreed upon in the contract
• Remove watermarks or metadata without permission

5.3 Portfolio Use

Arka Studios reserves the right to use images and videos for promotional purposes, including but not limited to our website, social media, and portfolio. Clients may request exclusion from promotional use, which must be agreed upon in writing before the shoot.

6. Deliverables

6.1 Delivery Timeline

Standard delivery timelines are:

• Photography projects: 1-3 weeks
• Videography projects: 2-4 weeks
• Large events or commercial projects: 3-6 weeks

Rush delivery is available for an additional fee. Delivery timelines begin after receipt of full payment.

6.2 Revisions

The number of revision rounds is specified in each package. Additional revisions beyond the included rounds will be charged at our standard hourly rate. Major changes to the creative direction may require additional fees.

6.3 File Storage

Arka Studios will maintain backup copies of delivered files for a period of 6 months from the delivery date. After this period, files may be deleted without notice. Clients are responsible for maintaining their own backups.

7. Client Responsibilities

Clients agree to:

• Provide accurate information about the project requirements
• Obtain necessary permissions for shoot locations
• Ensure all required participants are available at the scheduled time
• Communicate any special requirements or restrictions in advance
• Make timely payments as per the agreed schedule
• Provide feedback and approvals within reasonable timeframes to avoid project delays

8. Limitation of Liability

While Arka Studios takes all reasonable precautions to ensure the quality and safety of our work:

• Our total liability is limited to the fees paid for the specific service
• We are not liable for any indirect, incidental, or consequential damages
• In case of equipment failure or data loss, our liability is limited to re-shooting the session at no additional cost, subject to availability
• We are not responsible for delays or failures due to circumstances beyond our control (force majeure)

9. Model Release and Consent

For shoots involving identifiable individuals:

• Clients are responsible for obtaining necessary consent from all participants
• For commercial usage, proper model releases must be signed by all participants
• For minors, consent must be obtained from parents or legal guardians
• Arka Studios may request signed model release forms before commercial use

10. Disputes and Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana, India.

We encourage clients to first attempt to resolve any issues directly with us before pursuing legal action.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
